The United States Commodity Futures Trading Commission (CFTC) has begun a process to define how platforms offering retail customers financed, leveraged, or margin-based crypto asset transactions could operate under federal oversight. Its chairman, Michael Selig, announced an advance notice of proposed rulemaking and a possible new registration category for these markets.

The initiative seeks to establish a specific regulatory pathway for certain activities, but it does not require all cryptocurrency exchanges to register with the CFTC. Services involving margin, financing, or leverage could fall under the regime the agency proposes to develop; ordinary spot trading would not be included in this specific initiative. Open consultation and legal limits

The CFTC said it will accept written comments for 60 days after the notice is published in the Federal Register. That period is for public consultation and is not an effective date. The agency must consider the process before determining whether to adopt rules and what their scope would be.

The announcement follows the failure of the CLARITY Act, which would have addressed the regulatory structure for digital assets more broadly, to advance in Congress. The CFTC’s action relies on existing legal powers that the agency considers applicable; it does not replace passage of that law or, by itself, expand powers that Congress has not granted it.

Selig said the agency aims to provide “clarity, certainty, and consumer protection” through a national framework for these transactions. That is the purpose stated by the CFTC chairman, not a guarantee that the proposal will produce those results. For now, affected companies have a preliminary notice and a comment period, not definitive registration obligations arising from this initiative.
